Motionworks® Software Usage & Privacy Policy

Motionworks® International, LLC. (“Motionworks,” “we,” “us” or “our”) has a software-as-a-service (SaaS) platform that allows you to visualize and analyze first or third-party data to extract meaningful insights (the “Platform”). Prior to accessing the  Platform, we want to make sure that you, the user, understand the ways by which we and/or our third-party partners and vendors may use and disclose your information.

BY LOGGING IN, YOU REPRESENT AND WARRANT that you are an officer and/or employee of the entity whose location placed data is being processed by our Platform and as such, you have the authority to accept the usage terms set forth herein and YOU ACCEPT such terms and consent to the processing of your information as described below. 

Third-Party Apps

Our Platform uses the software of third-party applications to fulfill the more mundane functions of the Platform (as more fully explained below) so we can focus our resources on developing innovative solutions to meet your needs. Collectively, these applications enhance our ability to perform three core functions:

  1. Efficiently display custom maps and visualizations of first & third-party data based on user inputs.
  2. Should issues arise, open, manage and close support tickets and interact with users directly by opening a chat portal upon user request inside of our Platform to respond to user questions regarding their data, the Platform’s functionality or any identified bugs.
  3. Allow our support and customer experience team to playback user sessions to replicate the user’s experience and thereby obtain meaningful insight, identify usability problems and enhance our user’s overall experience. Data Privacy

It’s important to know that your data belongs to you but we may, either directly or indirectly, through our third-party vendors, collect information on your use of our website, such as pages visited, links clicked, non-sensitive text entered and mouse movements, as well as information more commonly collected such as the referring URL, browser, operating system, cookie information and Internet Service Provider (“Usage Data”). The purpose in collecting this data is to better understand how you are using our website.  Neither we nor our third party vendors, use the Usage Data to identify our users and it is not disclosed or used other than to send emails about our website or respond to inquiries, provide support for the services offered on our website; enhance or improve your experience or improve upon our services, monitor data to ensure that it complies with your contractual obligations to any third-party data provider; perform any other function that we believe in good faith is necessary to protect the security or proper functioning of our website or the performance of the Services, post testimonials along with those of other satisfied customers on our website in addition to other endorsements and other marketing efforts.

Our Insights

Motionworks® sources a variety of data to generate insights for our customers. This process begins with anonymized data which is further combined, removing any direct connection to source information such as personal records. We retain the data supporting this service for up to several years.

What we ask of our vendors

We at Motionworks® require our data providers to have your consent to use your data. In addition, we source aggregated data that generally does not identify individuals. If you choose to revoke your consent with one or more of our providers, they will notify us of your decision. Motionworks® will then erase any data we have which can be directly attributed to you.

Further, our third-party vendors may anonymize personal data so that it cannot be individually identified and publish this anonymized information as segmented by industry, geography, and other metrics to provide qualitative insight on the performance of their respective software products.  That information may be provided to us or their partners and it may be combined with other third-party information.   We require commitment from our third-party vendors to not disclose this anonymized data in a manner that would identify you as an individual.

Our Position on Measuring Visitation to Sensitive Locations

Motionworks® is committed to providing insights in an anonymized, aggregated, and privacy-compliant way across all of our solutions. Motionworks data ®do not provide insights on individual behaviors and cannot be reverse engineered or manipulated to provide such information.

Population intelligence summarized at specific locations or venues can be used in a variety of positive ways to help inform businesses, reduce costs, improve transportation networks, and strengthen city infrastructure. It is important to note that while Motionworks’ population intelligence products provide significant value, our outputs are limited to mobility information on generalized demographics and aggregated foot traffic for example. These products are well within the limitations of existing privacy legislation, as none of the products identify or characterize individuals.

Still, Motionworks® strives to go above and beyond the restrictions of all current privacy regulations to ensure the utmost respect for sensitive personal information. As part of this commitment, Motionworks® will not provide information on visitation to points of interest (POIs) that may be considered sensitive such as women’s health facilities, substance abuse centers and others.

We treat all locations uniquely and also take into consideration the specific type of activity or temporal elements of the study as well. In the case of measurements of locations that include mixed-use facilities analysis may be provided by Motionworks’ products only during the hours of specific events that meets our criteria for acceptable venue/event.

Changes

We may modify these terms or any additional terms that apply to the usage of our Platform to, for example, reflect changes to the law or changes to our Services. You may receive additional request for your consent to our use of your data when changes to our policies occur. You should look at the terms regularly. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for the Platform, you should discontinue your use of the Platform.
